Erik and Lyle Menendez Could Be Home 'Before Thanksgiving,' Advocate Says

“I believe [that] before Thanksgiving, they will be home. I still believe that,” Mark Geragos said in a press conference on Thursday, October 24, after Los Angeles County District Attorney George Gascón they recommended that the brothers be expelled because of new evidence related to their beliefs.
Gascón said at a press conference on Thursday that if his recommendation is accepted, Erik and Lyle will be “eligible for immediate release” since they were under 26 years old when they killed their parents. José again Kittyat their home in Beverly Hills, California, in 1989.
“We thank the DA for what they did today,” Geragos told reporters as he stood next to Erik and Lyle's family members. “Today is a big victory in that direction.”

Erik, 53, and Lyle, 56, were sentenced to life in prison without parole in 1996, however, Geragos filed an appeal in 2023, asking for a retrial on the grounds of the former Menudo member. Roy Rossellóallegations of sexual abuse against José, and a recently discovered letter from Erik to his cousin Andy Cano where he described his father's alleged sexual abuse a few months before the murder.
Gascón's recommendations will now go to the judge in the case, who will submit his proposal before the Parole Hearing Board.
“If there is a hearing. I say if, because there is no need for one person to be present, all these family members behind me will be heard,” said Geragos on Thursday. “All of these family members will ask one thing, that is, 'Bring them home.' Enough is enough.”

In a press conference last Thursday, Gascón said he believed that Erik and Lyle, who were 18 and 21 years old respectively at the time of the murder, “paid their debt to society” and “are safe to be integrated into society.”
The Menendez case has drawn renewed interest following the September release of a Netflix limited series about the brothers, Monsters: The Story of Lyle and Erik Menéndezand a documentary The Menendez Brothersreleased earlier this month.
Following Gascón's recommendation, Cooper Kochwho played the role of Erik in Monsters, praised the DA for his decision.

This case highlights the importance of challenging decisions and seeking the truth, even when there is no question of guilt.”
