Halle Berry Gets Custody Battle Victory Against Olivier Martinez
Halle Berry she found success in her ongoing custody battle with her ex-husband Olivier Martinez.
According to recent court documents obtained by Us Weeklya judge ruled in Berry's favor that Martinez, 58, failed to disclose his absence to participate in reunification therapy.
“The court is not persuaded [his] the argument that he could not continue with the joint treatment in the summer because he was traveling abroad and is not tech-savvy, “read the court. “[The] sessions are made by Zoom, too [he] demonstrated the ability to use Zoom in his June session … and his ability to have FaceTime calls [with their son] almost every day in the month of July. [He] I would have continued with fertility treatment … but she refused to continue participating in counselling.”
The court also ruled that Berry's attorney made several attempts to “rehabilitate the treatment,” which Martinez's team allegedly did not respond to.
“Because [he] did not participate in fertility treatment over the summer, halting the process of moving forward with fertility treatment,” the documents said, ruling that Berry's resulting costs “could have been avoided. [Martinez] he worked at the right time.”
A detention hearing is scheduled for December 12.
Us confirmed in August that Berry, 58, filed for sole custody of her son Maceo, 10, for one year after the inmates agreed to share physical and legal custody of their child. (Berry, who also shares a daughter Nahla with whom he lived Gabriel Aubry(She was married to Martinez between 2013 and 2015.)
In addition to shared custody of the children, Berry was ordered to pay Martinez $8,000 a month in child support and an additional 4.3 percent of any earnings he earns over $2 million. Berry also pays all of Maceo's school fees, extracurricular activities and health insurance.
A year later in July, Berry said in court papers that Martinez refused to attend their breeding lessons as previously agreed upon. Martinez, meanwhile, denied Berry's claims and filed her own petition to be granted legal custody.
Martinez filed a new court order last month, saying Berry is unwilling to pay his court costs.
“He refused to voluntarily surrender my fees,” he said. “This, despite admitting that when he did that in the past and he was willing to negotiate – which he is not willing to do now, we always resolved all the problems. Without his financial contribution, I will not be able to deal with his claims.”
Martinez went on to say that his “limited career” as an actor outside of the United States made the pairing difficult, but he still hopes they can resolve any animosity.
“Over the years our relationship has improved. I hope our relationship can return to this state. I don't have one and have never had a problem Van Hunt and support Van and Halle's relationship when I talk to Maceo,” Martinez said in her filing, referring to Berry's boyfriend. “However, I believe, based on Maceo's behavior and his comments to me, that Halle did not prepare Maceo for Van to become involved in their lives, and Maceo has expressed many concerns to me about Van.”
Martinez wants the former couple to “work on the way forward” for Maceo's benefit.
“In 2023, when Halle asked us to discuss finalizing our custody plan, I asked that we resolve all other remaining issues including child support,” he added, stressing that he will comply with all court orders.
Berry has yet to publicly respond to the claims.
